Terms of Service

Welcome to MyFishSpace. These Terms of Service ("Terms") govern your use of the MyFishSpace mobile application and related services ("Services"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction to consent to use of the Services) and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Account and Registration

You may need to create an account or sign in via a third-party provider (e.g., Google, Facebook). You are responsible for maintaining the confidentiality of your account and for all activity under it. You must provide accurate information and notify us of any unauthorized use.

3. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property or other rights of others
  • Upload false, misleading, or illegal content
  • Harass, abuse, or harm other users or third parties
  • Attempt to gain unauthorized access to our systems or other accounts
  • Use the Services to distribute malware or interfere with their operation
  • Resell, sublicense, or commercially exploit the Services except as permitted

We may suspend or terminate your access if we reasonably believe you have violated these Terms or for other operational or legal reasons.

4. Your Content

You retain ownership of content you submit (e.g., catches, photos, notes). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute that content as needed to provide and improve the Services (including making it visible to other users where the product allows). You represent that you have the right to grant this license and that your content does not violate these Terms or any third-party rights.

5. Subscriptions and Purchases

Some features may require a paid subscription or one-time purchase. Payment is processed through the app store (e.g., Google Play) or our payment provider. Refunds are subject to the applicable store or provider policy. We may change subscription prices or features with notice; continued use after changes may constitute acceptance. Free trials (if offered) may convert to paid subscriptions according to the terms presented at sign-up.

6. Intellectual Property

The Services, including the app, design, text, graphics, and other materials (excluding your content), are owned by MyFishSpace or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works of our materials without our prior written consent, except as allowed by the Services or law.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF MAPS, WEATHER, OR OTHER THIRD-PARTY DATA. USE OF THE APP FOR FISHING OR OUTDOOR ACTIVITIES IS AT YOUR OWN RISK; COMPLY WITH LOCAL LAWS AND REGULATIONS (E.G., FISHING LICENSES, CATCH LIMITS).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYFISHSPACE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF GREATER). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM PERMITTED BY LAW.

9. Indemnification

You agree to indemnify and hold harmless MyFishSpace and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or any third-party rights.

10. Third-Party Services

The Services may integrate or link to third-party services (e.g., maps, social login, ads, payments). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the content or practices of third-party services.

11. Changes to the Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website and updating the "Last updated" date. Your continued use of the Services after the effective date of changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the Services.

12. General

These Terms constitute the entire agreement between you and MyFishSpace regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right does not waive that right. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. Governing law and dispute resolution will be determined by the laws of the jurisdiction in which we operate, unless otherwise required by your local law.
